“We can readily imagine a series of possible responses. (1) Government might ban conspiracy theorizing. (2) Government might impose some kind of tax, financial or otherwise, on those who disseminate such theories.”
I’m sure we can imagine lots of ways to take away Constitutional rights. But, let’s not.
Writes Sunstein: “The idea that government should be neutral among all forms of speech seems right in the abstract, but as frequently applied it is no more plausible than the idea that it should be neutral between the associational interests of blacks and those of whites under conditions of segregation.”
Aha! The race card. The Jack of all Jacks. Throw it down and watch the judicial system scramble to see which justice can rule most politically correctly.
Seriously, though. What does my right to start a radio station, or to have a blog, or to even start a TV network and spout all the nonsense I want to have to do with racial segregation?
Don’t tread on me, Cass. Just don’t tread on me.
